1. About These Terms

These Terms and Conditions govern the travel planning and advisory services provided by Traveling the Atlas, LLC, a Kansas limited liability company ("Traveling the Atlas," "we," "us," or "our"), an independent affiliate of Gifted Travel Network. By requesting or using our services, you ("you," "the client," or "the traveler") agree to these Terms and Conditions in full. If you do not agree, please do not use our services.

2. Our Role as a Travel Advisor

Traveling the Atlas acts solely as an independent travel advisor and intermediary. We research, recommend, plan, and arrange travel on your behalf, and we book that travel with third-party suppliers such as airlines, hotels, resorts, cruise lines, tour operators, ground transportation providers, insurance companies, and other travel-related businesses (collectively, "Suppliers").

We are not the provider of any travel service. We do not own, operate, manage, or control any Supplier or the services they provide. The Suppliers are independent third parties, and the travel services you receive are provided directly by them, subject to their own terms and conditions.

Because we act only as an intermediary, Traveling the Atlas is not responsible or liable for the acts, errors, omissions, representations, warranties, breaches, negligence, or default of any Supplier, or for any injury, death, loss, damage, delay, cancellation, or other harm arising from the services provided (or not provided) by any Supplier.

3. Supplier Terms Govern Your Travel

All travel arranged through Traveling the Atlas is subject to the terms and conditions of the applicable Suppliers, including their booking terms, fare rules, cancellation and refund policies, change fees, liability limitations, and conditions of carriage. These Supplier terms form a direct contract between you and the Supplier.

It is your responsibility to review and understand each Supplier's terms and conditions before confirming any booking. By proceeding with a booking, you agree to be bound by those Supplier terms.

4. Fees and Payment

Traveling the Atlas charges professional planning fees for its services, as described on our website and communicated to you before work begins. Planning fees compensate us for the time, research, expertise, and personal attention involved in designing your travel, and are separate from the cost of the travel itself.

Planning and service fees are earned upon commencement of work and are non-refundable, except where required by law. Payment of a planning fee does not guarantee availability, pricing, or the completion of any particular booking.

Payments for travel bookings are made according to each Supplier's payment schedule and terms. You are responsible for making all payments by the deadlines provided. Failure to pay on time may result in cancellation of your booking by the Supplier, for which Traveling the Atlas is not responsible.

5. Cancellations, Changes, and Refunds

Cancellations, changes, and refunds are governed by the terms and conditions of the applicable Suppliers. Many travel bookings are non-refundable or carry cancellation penalties, change fees, or fare differences. These charges are set and enforced by the Suppliers, not by Traveling the Atlas.

Any planning or service fees paid to Traveling the Atlas are non-refundable regardless of whether you later cancel, change, or do not take your trip.

If you wish to cancel or change a booking, we will assist you in communicating with the relevant Suppliers, but we cannot guarantee any refund, credit, or accommodation, and any amounts recoverable are determined solely by the Suppliers.

6. Travel Insurance

We strongly recommend that every traveler purchase comprehensive travel insurance to protect against unexpected events, including trip cancellation, interruption, delay, medical emergencies, evacuation, and lost or damaged belongings.

If you decline travel insurance, you do so at your own risk and accept full responsibility for any financial loss that insurance might otherwise have covered. Traveling the Atlas is not responsible for any loss that would have been covered by a travel insurance policy you chose not to purchase.

7. Travel Documents, Health, and Entry Requirements

You are solely responsible for ensuring that you and everyone in your party holds valid passports, visas, permits, and any other travel documents required for your trip, and for meeting all health, vaccination, and entry requirements for every destination and point of transit.

Requirements vary by destination and can change without notice. We may provide general guidance, but such guidance is not a guarantee, and it remains your responsibility to verify current requirements with the appropriate authorities, embassies, and official sources. Traveling the Atlas is not responsible for any denied boarding, denied entry, loss, or expense resulting from missing, incorrect, or expired documents or from failure to meet health or entry requirements.

8. Accuracy of Information You Provide

You are responsible for providing accurate and complete information, including legal names as they appear on travel documents, dates of birth, contact details, and any special requirements. Errors in the information you provide may result in additional fees, penalties, or the inability to travel, for which Traveling the Atlas is not responsible.

9. Prices and Availability

All prices and availability are set by the Suppliers and are not guaranteed until booked, confirmed, and paid in full according to Supplier terms. Prices may change due to Supplier pricing, currency fluctuation, taxes, fees, surcharges, or availability. Traveling the Atlas is not responsible for price changes or availability outside of our control.

10. Limitation of Liability

To the fullest extent permitted by law, Traveling the Atlas, LLC, and its owners, employees, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any kind arising out of or relating to your travel, your bookings, the acts or omissions of any Supplier, or your use of our services.

Without limiting the foregoing, we are not liable for any injury, illness, death, loss, damage, delay, cancellation, schedule change, overbooking, mechanical or equipment failure, act of God, weather, natural disaster, government action, strike, civil unrest, terrorism, epidemic or pandemic, or any other event beyond our reasonable control.

In any event, and to the fullest extent permitted by law, the total liability of Traveling the Atlas for any claim arising out of or relating to our services shall not exceed the amount of the planning or service fees you paid directly to Traveling the Atlas for the specific trip giving rise to the claim.

11. Force Majeure

Traveling the Atlas is not responsible for any failure or delay in performance, or for any loss or damage, resulting from events beyond our reasonable control, including but not limited to acts of God, weather, natural disasters, epidemics or pandemics, government actions or advisories, border closures, strikes, labor disputes, war, terrorism, civil unrest, or Supplier insolvency or default.

12. Indemnification

You agree to indemnify, defend, and hold harmless Traveling the Atlas, LLC, and its owners, employees, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your travel, your bookings, your acts or omissions, your breach of these Terms, or your violation of any Supplier terms or applicable law.

13. Privacy

We collect and use the personal information you provide solely to plan, arrange, and support your travel, including sharing necessary details with Suppliers to complete your bookings. We do not sell your personal information. By using our services, you consent to this use of your information.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Kansas.

15. Changes to These Terms

We may update these Terms and Conditions from time to time. The version in effect at the time you engage our services applies to that engagement. Continued use of our services after any update constitutes acceptance of the revised Terms.
